Bhai, GST ke baare mein brokers mein bahut confusion hoti hai. Kuch ko lagta hai ki unhe registration ki zaroorat nahi. Kuch register hain par returns nahi bharte. Aur kuch hain jo sochte hain “yaar CA ko de diya hai, dekhega woh.”

Threshold Limit — Kab Registration Compulsory Hai

Service Provider Ke Liye General Rule

Agar tumhari annual service income (commission/brokerage) Rs. 20 lakh se zyada ho jaati hai — GST registration compulsory hai.

Exception (Special Category States): Kuch states mein yeh limit Rs. 10 lakh hai. Inme shamil hain:

  • Manipur, Mizoram, Nagaland, Tripura, Meghalaya, Arunachal Pradesh, Sikkim, Uttarakhand, Himachal Pradesh, Jammu & Kashmir (UT), Puducherry

Agar tumhara brokerage income Rs. 20 lakh se kam hai: Voluntary registration kar sakte ho — kyunki kuch benefits milte hain.


Voluntary Registration Kyun Karein (Even Below Threshold)

Builder relationships: Bade builders channel partners se GST invoice maangne lagte hain. Agar tumhare paas GST nahi hai — woh commission tax-deducted nahi kar sakte cleanly. Kuch builders sirf GST-registered brokers ke saath kaam karte hain.

ITC (Input Tax Credit): GST-registered hone ke baad tum apne business expenses pe jo GST di hai woh claim kar sakte ho. Marketing, software, office expenses pe GST recovery hoti hai.

Registration Process — Step By Step

Documents Required

Identity:

  • PAN Card (compulsory)
  • Aadhaar Card

Address:

  • Business address proof — rent agreement ya property tax receipt (home office ke liye khud ka address chalega)
  • NOC from property owner if rented

Bank:

  • Bank account details — IFSC code, account number, cancelled cheque

Photo:

  • Recent passport size photograph

RERA Registration (helpful to show as broker identity):

  • RERA registration certificate

Registration Steps

Step 1: GST Portal Pe Jaao gst.gov.in → New Registration

Step 2: Part A — Basic Info

  • Taxpayer type: “Regular” select karo
  • State, district fill karo
  • Legal name (as per PAN)
  • PAN number
  • Email aur mobile — OTP verification hogi

Step 3: TRN Generate Hoga Temporary Reference Number — 15 din ke liye valid

Step 4: Part B — Detailed Info TRN se login karo aur fill karo:

  • Business details — trade name, business start date
  • Promoter details — aapki personal info
  • Principal place of business — address
  • Bank account details
  • HSN code for your service (real estate brokerage)
  • Documents upload karo

Step 5: Verification DSC (Digital Signature) ya EVC (Electronic Verification Code) se sign karo.

Step 6: ARN Generate Hoga Application Reference Number. Track karo status pe.

Step 7: GSTIN Allotment 7-15 working days mein GSTIN (15-digit GST Identification Number) allot hoga.


HSN/SAC Code — Broker Ke Liye

GST registration aur invoice mein service ka code dena hota hai.

For Real Estate Brokers:

  • SAC Code: 99721 — Real estate services involving owned or leased property
  • SAC Code: 997212 — Real estate agency services for residential properties on a fee or contract basis

Apne CA se confirm karo kaunsa code tumhari exact service ke liye apply hota hai.


GST Rate — Kitna Tax Dena Hoga

Real estate brokerage service pe 18% GST lagti hai.

Example calculation:

  • Commission earned: Rs. 75,000
  • GST @ 18%: Rs. 13,500
  • Total invoice amount: Rs. 88,500

Builder/buyer (whoever pays commission) tum se Rs. 88,500 deta hai. Usme se Rs. 75,000 tumhara income, Rs. 13,500 tumhe government ko dena hai.

GST aapka khud ka tax nahi hai — yeh collected tax hai. Tum collector ho, taxpayer nahi (technically). Yeh confusion zyada logon ko hoti hai.


GST Invoice Kaise Banao

GST-registered broker ko proper Tax Invoice issue karna hota hai commission ke liye.

Invoice mein must-have:

  • “Tax Invoice” clearly likha ho
  • Tumhara GSTIN
  • Client/builder ka GSTIN (agar registered hai)
  • Invoice number aur date
  • Service description — “Real estate brokerage services for [property details]”
  • SAC code
  • Gross amount
  • GST rate (18%) aur GST amount (separately CGST 9% + SGST 9%, ya IGST 18% if inter-state)
  • Total amount

Registration hone ke baad returns file karna compulsory hai. Non-filing pe penalty lagti hai.

GSTR-1 — Sales Returns

Frequency: Quarterly (agar annual turnover Rs. 5 crore se kam) ya Monthly

Kya file karna hai: Har woh invoice jo tumne issue ki — builder ko ya buyer ko commission ke liye.

Due date: Quarterly ke liye mahine ke end ke baad 13th.

GSTR-3B — Summary Return

Frequency: Monthly

Kya file karna hai: GST collected ka summary, GST paid ka summary, net payment ya refund.

Due date: Har mahine 20th.

GSTR-9 — Annual Return

Frequency: Yearly

Due date: December 31 of the next financial year.


ITC (Input Tax Credit) — Benefits Samjho

Yeh GST ka sabse big benefit hai registered businesses ke liye.

Agar tum business mein kuch khareedete ho aur us pe GST pay karte ho — woh GST tumhare GST liability se minus ho sakti hai.

Examples:

  • Laptop kharida business ke liye — Rs. 50,000 + 18% GST = Rs. 9,000 GST paid
  • Phone bill — Rs. 1,000 monthly + 18% = Rs. 180 GST
  • Software subscriptions — GST inclusive
  • Property portal subscription — GST applicable

Yeh sab GST tumhari collected GST se claim kar sakte ho — net liability kam hoti hai.

Condition: Expenses business-related hone chahiye aur supplier GST-registered hona chahiye.


Common GST Mistakes Jo Brokers Karte Hain

Mistake 1: Registration Delay Karna

“Abhi income Rs. 20 lakh se kam hai” — true, par agar income suddenly zyada ho jaaye aur retroactively register karna pade — late registration penalty + interest lagta hai.

Mistake 2: Returns File Nahi Karna

Registration hai par returns nahi fill ki — GSTIN suspended ho sakta hai. Builders aur clients ka payment atak sakta hai.

Composition Scheme — Kya Broker Apply Kar Sakta Hai?

Composition scheme (1% flat tax, simple compliance) sirf manufacturers aur small traders ke liye hai — service providers ke liye available nahi.

Broker = service provider = Composition scheme nahi milega.

  • Annual income Rs. 20 lakh ke paas aa rahi hai
  • Multiple states mein kaam karte ho (inter-state services)
