Yaar, kitne logon ne rent agreement bina padhe sign kiya hoga — “bhai wahi standard format hai” bolke. Aur baad mein jab dispute hua, tab pata chala ki koi important clause tha hi nahi, ya jo tha woh landlord ke favor mein tha.

Types of Rent Agreements — Pehle Clear Karo
11-Month Agreement (Most Common)
- Validity: 11 months
- Kyun 11 mahine: 12 mahine ya usse zyada ka agreement officially “lease” ban jaata hai aur registration mandatory ho jaati hai. 11 mahine mein notarization optional hai (state-wise vary karta hai)
- After 11 months: Renew karo same terms pe ya renegotiate
Long-Term Lease (12 months+)
- Registration mandatory — Sub-Registrar office mein
- Stamp duty applicable
- Zyada legal protection milti hai tenant ko
Leave and License Agreement (Maharashtra mein common)
- Technically different from rent — license deta hai occupy karne ka, not a tenancy
- Easier to terminate compared to regular lease
- Maharashtra Rent Control Act se protected nahi

Standard Format — Section by Section
Section 1: Header and Parties
RENT AGREEMENT
This Rent Agreement is executed at [City], on this [Date] day of [Month], [Year].
BETWEEN
[Landlord Full Name], aged [Age] years, residing at [Full Address],
hereinafter referred to as the "LANDLORD/LICENSOR" (which expression shall include
legal heirs, successors, and assigns)
AND
[Tenant Full Name], aged [Age] years, residing at [Current Address],
hereinafter referred to as the "TENANT/LICENSEE" (which expression shall include
legal heirs and permitted assigns)
Important: Proper names exactly as in Aadhaar/PAN. Spelling mistake later problem ban sakti hai.
Section 2: Property Description
WHEREAS the Landlord is the lawful owner of the property situated at:
[Complete Property Address including flat number, building name, floor,
society name, street, area, city, PIN code]
The said property consists of: [BHK type], with [list: parking, terrace,
storage if applicable]
Total carpet area: approximately [XXX] sq. ft.
Pro tip: Specific mention karo kya included hai — furnished items, appliances, parking slot number, etc.
Section 3: Term
This agreement shall be in force for a period of ELEVEN (11) months,
commencing from [Start Date] to [End Date].
After the expiry of this agreement, the same may be renewed by mutual
consent of both parties with revised rent and terms.
Section 4: Rent and Payment
1. The Tenant agrees to pay a monthly rent of Rs. [Amount] (Rupees [In Words] Only)
to the Landlord on or before the [Date, e.g., 5th] of every English calendar month.
2. The rent shall be paid by [mode: bank transfer/UPI/cheque] to:

3. In case of delay beyond [Date] of month, a late fee of Rs. [Amount] per day

Section 5: Security Deposit
The Tenant has paid a refundable security deposit of Rs. [Amount]
(Rupees [In Words] Only) to the Landlord.
This deposit shall be refunded to the Tenant within [30/60] days of vacating
the property, after deducting any outstanding rent, utility dues, or damage
repairs (if any).
The deposit shall not bear any interest.
Important clause: Refund timeline clearly specify karo. Without this, disputes bahut hote hain.
Section 6: Utility Bills
1. The Tenant shall be solely responsible for paying electricity, water,
gas, and internet bills for the duration of the tenancy.
2. Monthly society maintenance charges of Rs. [Amount] shall be paid by
the [Landlord/Tenant — specify clearly].
3. Property tax and other government levies shall be borne by the Landlord.
Section 7: Tenant’s Obligations
The Tenant agrees to:
1. Use the premises only for residential/commercial purpose [specify].
2. Not sublet, assign, or transfer the premises without written consent.
3. Not make any structural alterations or modifications without consent.
4. Maintain the premises in good condition and return it in same state.
5. Allow the Landlord to inspect the property with 24 hours prior notice.
6. Not indulge in any illegal activities on the premises.
7. Comply with society rules and regulations.
8. Not create nuisance or disturb neighbors.
Section 8: Landlord’s Obligations
The Landlord agrees to:
1. Ensure peaceful possession of the property throughout the tenancy.
2. Be responsible for major structural repairs (roof, walls, plumbing,
electrical systems — not day-to-day maintenance).
3. Not disturb the Tenant's peaceful occupation without reasonable cause.
4. Return the security deposit within agreed period after vacating.
Section 9: Termination
1. Either party may terminate this agreement by giving [1/2] month's prior
written notice.
2. In case of breach of any terms, the aggrieved party may terminate with
immediate effect after serving written notice.
3. On termination, the Tenant shall vacate the property and hand over
keys within [7] days.
Section 10: Lock-In Period (if applicable)
There shall be a lock-in period of [X] months from the commencement date.
During this period, neither party may terminate the agreement.
If the Tenant vacates before lock-in expiry, [X months' rent as penalty]
shall be forfeited from the security deposit.
Section 11: Furnished Items List
The property is rented with the following items:

Stamp Duty aur Notarization — State Wise
Maharashtra:
- Stamp duty on security deposit — 0.25% of total rent for 11 months + security deposit
- Notarization: Mandatory for Leave & License
Delhi:
- Stamp paper Rs. 50 to Rs. 100 — 11 month agreement
- Notarization: Recommended but not mandatory
Karnataka:
- Stamp paper required
- Registration advised for longer tenancy
Uttar Pradesh:
- Rs. 100 stamp paper typically
- Notarization optional
Note: State-wise rules change hote rehte hain. Local sub-registrar office ya property lawyer se confirm karo applicable stamp duty.
Broker’s Checklist — Agreement Final Karne Se Pehle
- Both parties ka Aadhaar photocopy liya
- Landlord ka ownership proof verified (sale deed ya property card)
- Landlord ka NOC agar it’s a co-owned property
- Furnished items list complete hai
- Security deposit amount clearly mentioned
- Maintenance responsibility clearly assigned
- Notice period mentioned
- Lock-in period (if any) mentioned

Common Mistakes Brokers Karte Hain
